BREAKING: The 5th Circuit has ruled on #DACA, largely upholding a lower court ruling finding the policy unlawful.

It allows renewals to continue temporarily & has sent the case back to the lower court to consider @POTUS's new DACA regulation, which goes into effect on 10/31.
To be clear: This decision doesn't change who can currently apply for or renew DACA for now.

And at the same time, immigrant youth CANNOT continue to live under unceasing politicized attacks on DACA, and thus, their lives.

This painful uncertainty must end. #HomeisHere
DACA is a successful and commonsense policy that has transformed lives, improved our economy, and strengthened our nation.

It is legally and morally right, but it was always meant to be temporary.

Nothing has changed today. DACA renewals remain open to folks with current DACA. Folks with DACA can apply for advanced parole. And first-time DACA applications, sadly, can be accepted but not adjudicated. Today was just an important set of court papers being filed. āš–ļøšŸ“° /2
This case involves TX (& a handful of other states) who sued to end DACA claiming it is illegal. They won in district court in July 2021, and the case is now up on appeal to the 5th Circuit. The 5th circuit now has all the papers before it & could issue its ruling any day. /3

When President Obama established #DACA 10 years ago, our nation took a landmark step to honor our heritage as a land of immigrants & advance our promise of opportunity for all. Since then, courageous young immigrants have been empowered to proudly pursue their American Dream.
Rightfully, DACA has stood the test of time: enduring a decadeā€™s worth of cruel and partisan assaults from anti-immigrant forces. Just two years ago, Americans rejoiced as the Supreme Court struck down the Trump Administrationā€™s illegal, immoral attempt to terminate DACA.
But in just a few weeks, the future of DACA will again be on the line in a case before the Fifth Circuit Court of Appeals. This and similar attacks reaffirm the need for real, permanent action to deliver the security and stability our Dreamers need and deserve.

The recent attention in the media to the pressing issue of #DocumentedDreamers gives us an opportunity to take a bigger view of immigration issues. The issue of kids aging-out is an unintended though not unforeseeable consequence of massive #GCBacklogs.šŸ§µ šŸ‘‡ 1/9
Fundamentally, this is a demand-supply and allocation issue. The number of #GC annually given out has not changed meaningfully since 1990. Meanwhile the US economy and labor market today are completely different from back then. 2/9
On top of this supply issue of #GC is the fact that their allocation is not equitable. How long you wait in line, usually boils down to the country you were born in. Not on skills, education, work experience, duration of stay in the US or contribution to the economy. 3/9

A thread on #DACA. It underscores the vast disparities in our legal system that it took 9 years for DACAā€”an erasure of immigration lawā€”to be held unlawful, while 45 was instantly enjoined from upholding immigration law (e.g. expedited removal). The imbalance is unsustainable. 1/7

Into the legal weeds of DACA: The Biden Admin has reiterated that it intends to bolster #DACA by issuing a regulation after a notice & comment process. This will address PART, and only part, of Judge Hanen's legal critique of DACA which led to Friday's injection. THREAD 1/x
One of the legal objections to DACA has been that the Obama Admin issued it as a general policy statement (which can be done quickly), rather than giving the public notice and allowing comment, before issuing regulations. 2/x

As expected, Judge Hanen has issued an order that is out of sync with other legal interpretations on #DACA and effectively halts the program for new applicants. A thread on what the order does -- & doesnā€™t -- mean 1/8
First, the order should underscore for everyone watching that the clock ā° is ticking for Congress to act on #immigration. They needed to act 20 years ago, and they REALLY need to act now. But hereā€™s what folks need to know now 2/8
Current DACA recipients are safe for now. While the order vacates the entire program, the Court has said that DHS can continue to process renewals for now. We donā€™t know how long this will last, so if youā€™ve been waiting to renew, make sure to do it now. 3/8

The Biden DOJ is speaking now and is discussing the Friday announcement that DHS would begin a rulemaking on #DACA and saying at minimum it will make substantive changes to the program.
First question from the Judge to DOJ: when is that rule making going to happen, anticipating that Texas will say "judge we have been waiting years for a decision."
