Though corporations in America routinely break the law, often with fatal consequences, it's fair to say America has no corporate criminals, because to have criminals, you need a criminal *system* that identifies criminal conduct and holds it to account. 1/ An old-timey prison mugshot in which the Wall Street 'Chargi

Almost daily, through my work providing advice and advocacy to vulnerable families in education settings, I hear from another family whose child's #privacy has been breached by education officers and headteachers at Scottish local authorities. #childrensrights 1/
Systematic breaches of data processing laws are becoming endemic in Scotland. I've even had two LAs tell me that they can break data processing laws because their local policies say they can. 2/
And now we have a report from SHEF that backs that up with evidence from all over the country. @ICOnews and @cypcs can't ignore these breaches anymore. 3/

@metpoliceuk have taken over 2yrs to complete my request. A request they are legally required to complete in 1 month. They dont seem to care about human rights. I'm now trying to shame them in to compliance. @EHRC @ICOnews @IOPC_Help @PoliceChiefs @MayorofLondon @CressidaDick
Whilst this is rather tongue in cheek it's really a very serious situation. The right to privacy is a fundamental human right enshrined in various pieces of legislation, most notably article 8 of the European Convention on Human Rights. @EHRC @metpoliceuk @IOPC_Help
The highlights/low-lights of the last two years interacting with @metpoliceuk include: (1) You sending my data to the wrong address three times despite being told before and after each occasion, you had the wrong address (multiple data breaches).

Dear Italian #DPA, #Garante #Privacy, please, take a stand and help us:
New Lombard regulation "highly recommends" the employer to use the local #ContactTracing App, and asks to push the employee to use the App, daily submitting the health checklist.

@meobaldo Image
AllertaLom #App is quite far from @edpb and DPA guidelines.
The privacy policy is opaque, contradictory, and misleading. There is even a #tracker embedded.

App rises a lot of worries and is almost compulsory.
Local government will enforce the use of this warmly-suggested App Image

IMPORTANT: While "contact tracing" is essential to curbing the spread of #COVID19, new polls show many Americans don't want to do it. Here’s what it actually is & why we as doctors think it's the best route to re-opening the country. Please share with anyone who needs this info.
First: What is #contacttracing? It simply means that when someone tests positive for a contagious illness, you try to determine who came into close contact with them & may also be at risk. Then you might test and/or quarantine those folks, to control the illness's spread. (2/13)
As a doctor, when I see patients with suspected #COVID19 in my ER, they get a test & results. But beyond that patient in front of me, I can't do much to control the spread to all the people they came into contact with. Contact tracing helps immeasurably with this. (3/13)

As an ER doctor, my biggest concern right now is that many view the current situation with #COVID19 as a death match between public health & the economy. This thinking is totally wrong & will lead to both more people dying AND the economy failing to rebound. Here's why... (1/13)
I've been a doctor for 17 years in a rural part of Michigan, a state that's been hit especially hard by the #coronavirus #pandemic. I see up close the battle between “health” and the “economy” that seems to be playing out across our states’ capitols and in Washington DC. (2/13)
The very real economic misery caused by our necessary response to the current public health crisis is leading to alarming policy developments. Some politicians and a very vocal minority of citizens are calling to “open the economy,” irrespective of the health consequences. (3/13)

As an ER doc in Michigan seeing @realdonaldtrump encourage protestors in our capital, I'm deeply concerned about the impact it will have on my patients. With hundreds gathering in close quarters, the potential spread of #coronavirus puts my community at risk. Here’s how: (1/14)
Over 300 people were there & it's estimated that 5-10% of the population are infected. If just 30 were infected (with an R0 of 2.5 and a 5 day incubation), those 30 people could result in nearly 11,000 newly infected Michiganders in 1 month - all thanks to these protests. (2/14)
The protesters donning TRUMP signs & MAGA hats say they were there to fight @GovWhitmer’s #StayHomeStaySafe order & extension of emergency powers. Well, gathering in the way they did is exactly how to ensure we'll be living under *stricter* #shelterinplace in coming weeks. (3/14)

As an ER doctor in a rural hospital, I have serious concerns over @realdonaldtrump’s "plan" to #OpenAmericaUpAgain. While the framework seems logical, the entire plan depends, in Dr. Birx’s words, on “the persistence of high level testing.” Here’s my concern: (1/9)
There's a real danger in opening too soon. "Hot spots" still haven’t defined the true number of cases due to a lack of testing -- and not testing asymptomatic people. In my area, we are nowhere near a peak and could create a hot spot that could overwhelm my hospital. (2/9)
In rural hospitals like mine, we run with limited resources of staffing on a regular basis. Just a handful of critically ill #COVID19 patients above our baseline could stretch our one nighttime respiratory therapist too thin and jeopardize patient care. (3/9)

President Bone Spur's abandoned his troops under heavy fire

The Federal Govt's standing in the way of our front lines getting the Protective Equipment they need

His inability to appropriately enact the Defense Production Act & to repair our broken Supply Chain is KILLING people
Think of clothing brands. If the US Govt used #DPA to ensure that every clothing manufacturer making clothes in the US turn their factories around to make Masks & Gowns then we'd see a surge of product available for the States while supplying much needed jobs. But they haven't.
If instead of ASKING Corporate giants to 'promise' to make ventilators in exchange for PR...what if he just TOLD them to just get it done. The US Govt could've said 'You've got 1 month, start producing'. #DPAnow should be happening but Trump doesn't wanna risk pissing off donors.

Maybe if Trump hadn't fired the entire Executive Branch Pandemic response team 2 yrs ago without replacing them

If Trumps administration hadn't axed the experts,
maybe the stockpile would've been maintained

& maybe the Fed Govt wouldn't be shipping States BROKEN ventilators now
Maybe if we had an expert Executive Branch Pandemic team coordinating a response they would've strongly advised Pompeo NOT to collect donations of 17.8 tons of critical Medical #PPE & ship it OUT OF THE COUNTRY over a month AFTER the CDC warned this pandemic was coming to the US.
And of course after the US donated tons of medical supplies to China, we see China turn around & sell $467 MILLION in PPE equipment that we in the US DESPERATELY need to SPAIN despite the fact that our State Dept's now desperately trying to buy PPE overseas cause we need #PPENow

I hope Rachel @maddow @MaddowBlog can do a show weaving together these facts to get it through to people just how dangerous Trumps mishandling is
FACT 1: They knew from at least Jan 3rd to prepare yet Feb 7th they shipped 17.8 tons of critical medical supplies OUT OF THE COUNTRY
After depleting the stockpile Feb 7th why didn't they immediately start manufacturing masks & respirators to replenish the supply?
FACT 2: States are begging the Federal Govt to help source supplies. Of items NY requested they got 2%. Florida received 200% of what they requested.
FACT 3: Feb 7th the US donated vital supplies to China & other countries. On March 25th China sold $467 million in medical supplies to Spain🤯We have healthcare workers w/ garbage bag gowns & don't have enough ventilators but we donated to China who had enough to sell to Spain😡

Unfortunately, Donald Trump’s empty words once again haven’t led to any meaningful action. Lives are on the line, and Trump’s stubborn refusal to use the #DefenseProductionActNow to further ramp up production of #PersonalProtectiveEquipment & ventilators is a dereliction of duty.
Trump’s dithering response & refusal to exercise the #DefenseProductionAct to marshal a full-scale mobilization will result in fewer ventilators being produced. Bottom line: because of this, many Americans who otherwise could have been saved will die.
This isn’t fear-mongering, it’s math. We simply do not have enough #PPE and #Ventilators to protect healthcare workers on the front lines combating the #COVID19 pandemic AND keep Americans alive who suffer severe illness weeks after becoming infected.

Yesterday, I strongly urged the President to use the #DefenseProductionActNow and take *decisive* action to ramp up production of ventilators and other critical equipment has long past.
It is a positive sign that the President finally indicated he IS taking action under the #DPA&I reiterate my call to the President yesterday that he should exercise DPA title I, III and VII authorities to *require* a nationwide mobilization of manufacturing capacity to boost...
ventilator production & efficiently distribute equipment to medical systems most in need. Ventilator production is a complex supply chain and they must be manufactured w/strict quality control. ImageImage

The Italian #DPA (data protection watchdog) has received an inconvenient question during a #GDPR worksop. What GDPR role for the "supervisory board for organisational management & control Model" (#OdV)?
-data processor?
-joint controller?
-data controller (third party)?
...(1/3) Image
The DPA took time to reply (very appreciated) and asked to experts in Garante HQ.

After a while, they confirmed that... there is a think-tank that is focusing on the role of the supervisory board.

(2/3)
So, actually there is not a clear solution now.

Meanwhile, everybody have to deal with it and every DPO has to struggle with companies, lawyers, auditors, supervisory board members, accountants, bar's wrong guidelines, etc.

Italian #DPA lock down the risky #surveillance law that aim to have (biometric_identification+cctv+smart_image_analisys) to check public employees punch-in and punch-out.
This time DPA analyze implementing decree.
In october 2018 the DPA did the same on the draft of the main law Image
The law is already in force (D.Lgs 56/2019) but it lacks of application rules.

The DPA is highlighting and pointing out all the issues related to the law itself ant to the application rules, that are conflicting with the #GDPR main #principles.
Main issues are:

1) terms and #definitions don't match with GDPR definitions. they have to be lined up
2) principles of #Necessity & #Proportionality are completely unattended
3) the new biometric gates can't be #mandatory
4) #alternative gates should be available if needed

IMHO there are two main focus points spotted in the #Italian #DPA (Garante Privacy) sanction to Italian major political party and associations published April 4th.
They are so important that every data controller must rethink #GDPR compliance: Image
2/
1) OBSOLESCENZE IS A FAULT!
Data controllers have to update their software. I know that "fixing what is not broken is an error"... but you have to grant protection and patched software.
3/
2) OLD STYLE MANDATORY TECHNICAL AND ORGANIZATIONAL MEASURES ARE NO MORE MANDATORY, BUT YOU HAVE TO IMPLEMENT THEM BECAUSE THEY ARE STILL OBVIOUSLY ALWAYS NEEDED.

It's been brought to my attention that a small handful of #NDP propagandists are attempting to discredit my #SNCLavalin - #IndigenousDirective timeline RE Jody Wilson-Raybould, Jane Philpott, PMJT, etc, to other #CDNmedia journalists

Please let it be known, without a shadow of a doubt

#NDP Leader, Jagmeet Singh, did in fact speak with the CEO of #SNCLavalin about a DPA

So did the NDP's MP for Sherbrooke, Québec, Pierre-Luc Dusseault

The record ► lobbycanada.gc.ca/app/secure/ocl…

It's disappointing the #NDP would add to #SNCLavalinScandal by attempting to mislead #CDNmedia & #Elxn43 voters

If they're interested to learn the facts, here is everyone #SNCLavalin lobbied for a deferred prosecution agreement (aka #DPA)

1/4 This is huge!! As far as I know, the UE has issued the FIRST Rapid Alert (#RAPEX) for dangerous products that may be related to data protection and #Privacy.
This drive me crazy: the product is a smartwatch for MONITORING KIDS (#ENOX SAFE KID ONE with GSM and GPS integrated)
2/4 Now the #smartwatch must be recalled from end users! The App, the server and the watch has no security in data transmission. The risk is very high due to young users… I hope that this will be notified to #DPA too for #GDPR enforcement.
3/4 I’m very happy to see #dangerous #products withdrawn from the market due to lack of data protection. It is the very first time. I hope that the monitoring system will keep on focusing on data protection. ec.europa.eu/consumers/cons…

I see Security Companies using fear-based #marketing, relying on data #breaches and #sanctions.
I see #DPA enforcing the law and highlighting fines and sanction. It is not marketing but is fear-based communication.
This may not be the best approach to #GDPR Image
I see the Big (tech companies) waiting, #procrastinating and, few illuminated ones, trying to apply tiny, useless, merely esthetical #changes .
This clearly is not the best approach to #GDPR at all.
Very few are spreading reliable #gdpr knowledge, #Howtos, best practices, good drafts to apply and to start working on gdpr compliance. Yes, because many has not started yet.
I see many #SME waiting, struggling in #fear, scared by costs and by incoherent informations.
