This week, Vanuatu and fifteen other nations circulated a draft #UnitedNations #GeneralAssembly #UNGA resolution requesting an advisory opinion from the International Court of Justice relating to the obligations of States in respect of climate change.

Clausewitz said, in his famous work “On War” (as often cited as it is little read), that war is the continuation of diplomacy by other means, well it says a lot more things, but i will keep just a few as i do not wanna write too long.
In his chapter 1, Clausewitz refers that "war constitutes... an act of force that is carried out to force the adversary to comply with our will." War, therefore, is a duel of wills, which, in itself, is not enough, since wanting is one thing and power is another.
Does not intervene who wants but who can, as it is said in #InternationalLaw

To impose our will, we need resources, in an amount that exceeds what our adversary can muster, first of all energy.

After the ICJ’s 2012 judgment in Germany v. Italy (link below), the Italian Parliament passed Law 5/2013. That law required Italian courts to decline jurisdiction in claims against Germany of the kind which had given rise to the ICJ litigation. 👩🏻‍💼

Little did they know that the #ConstitutionalCourt would declare that law unconstitutional a year later, in the now-famous Sentenza 238/2014. 🙅🏻‍♂️

As a result of the efforts of Raphael Lemkin, the term #genocide was included in the Indictment for the #Nuremberg Trials of 1945-46 under the category of War Crimes.
British deputy chief prosecutor Sir David Maxwell Fyfe used the term in June 1946 #Nuremberg during his cross-examination of Konstantin von Neurath, former Reich Protector of Bohemia and Moravia.
Maxwell Fyfe reminded Neurath that the prosecution was charging him and many of his fellow defendants with genocide, “which we say is the extermination of racial or national groups.”

In his closing speech at the #Nuremberg Trials in 1946, British chief prosecutor Sir Hartley Shawcross used the term #genocide to describe the Nazis’ “deliberate and systematic plan” to wipe out peoples and cultures.
Shawcross revisited the evidence about the Einsatzgruppen and Auschwitz.

But he also reminded the Tribunal that #genocide had not been limited to the murder of Jews and Gypsies.
Shawcross emphasized that the Nazis had pursued genocide “in different forms” in Poland, the Soviet Union, Yugoslavia, Czechoslovakia, and Alsace-Lorraine.

1. The ICJ found strongly in favour of Ukraine’s arguments vs Russia in stark & direct language.

2. ICC Prosecutor @KarimKhanQC physically visited Ukraine.

3. The CoE cast out Russia with immediate effect.
ICJ ordered the following provisional measures - the Russian Federation:-

1. shall immediately suspend the military operation in the territory of Ukraine

RUSSIA'S EXPANSION
1. While most analysts see primarily a crime, I see primarily an error in Putin’s recognition of the two Russia-created East Ukrainian pseudo-states. This and the entry of regular Russian troops into the occupied territory are doubtlessly criminal & worrisome.
2. Yet, the East Ukrainian reality on the ground has so far not changed much with this "illegal legal" act and additional military presence. Instead, the larger political constellation of the conflict is arguably shifting to #Russia's disadvantage.
3. First, the always dubious and #Kremlin-imposed #MinskAgreements will not any longer be available as instruments of #Russian political pressure on #Ukraine. Second, the #West will now close ranks with Ukraine in view of #Russia's new blatant violation of #InternationalLaw.

1) Let's game out what a realistic independence movement in #space might look like. AS ALWAYS these views are my own. We're going to need to draw from #spacelaw, #internationalrelations, #InternationalLaw, and #history here. A thread.
2) Let's posit that the goal is a sovereign, self-governing habitation on #Mars, free-floating, or on the #Moon, not subject to control by a terrestrial country. How do we get from where we are now to there? Yes we've all read Moon is a Harsh Mistress and the Red Mars trilogy.
3) The first thing to realize is that you can't do this in one step. Ops in space are entwined with terrestrial activities and governments so separation is hard. As for law, the #OuterSpaceTreaty requires countries to exercise jurisdiction & control over activities, even private.

I have just emerged from a long desk day advising on the law of the land to discover it has been a shameful day for law, and the rule of law, in the UK.

Something is rotten in any state that promotes this.

And one doesn’t get credit for breaking just a little bit of the law.
