Thread on city bail reviews from 4/24. Again, only observations on some cases where information was available. Multiple prosecutors and defense attorneys participated. The proceedings were overseen by Judge Althea Handy, herself a former prosecutor.
A 21 yo defendant was released to pre-trial with 6/16/20 trial date. Incarcerated since Jan, state argued for him to be held despite offering plea deal for 6 mos and telling def. atty that in front of Judge Phinn they would offer time served next week. ASA was Michael Dunty.
Another def, accused of "assisting someone stabbing a victim" and incarcerated since Nov, was held as a danger to society. This is despite health factors that include a TBI & asthma. Handy noted TBI isnt a covid risk factor, however, said nothing about his asthma. 1/2

As this post gains traction, let's reiterate that the issue with "#NuisanceLaws" isn't that recipients of abuse should be able to call 911 as much as they need, but that calling 911 is itself not the solution to intervening and preventing partner violence #SurvivedandPunished
If the police system is overloaded with calls for help form survivors of abuse, it says everything about that system that its solution to this problem is evicting and displacing survivors, not providing safe housing, counselors, healthcare, childcare, etc. #SurvivedandPunished
The takeaway is that it's a mistake to look to the police and prison system to solve partner violence--which is rooted in poverty, toxic masculinity, mental health disparities--all the things the police/prison system keeps in place #SurvivedandPunished #NuisanceLaws

#FreeThemAll THREAD 1/ We see how the courts often target survivors of abuse. Leena, a young Black mother, fled her apartment after being attacked by her abusive partner. He called police & accused her of assaulting him & Leena was arrested, despite having been assaulted herself
2/ Leena was brought to court & formally charged with felony assault. The judge set $2500 bail that Leena could not afford, so Leena was sent to Rikers Island for two weeks. She had recently been hit by a car, out of work and living in a shelter, so $2500 was impossible to raise
3/ Even when her case was dropped to a misdemeanor and bail reduced to $750, hundreds of dollars--and her freedom--were still out of reach. It was a few days before Thanksgiving and she needed to get out to see her kids. She was brought to court and offered a choice:
