💥 1. Cuixart and Sànchez should have been processed by ordinary courts in Barcelona as they are civilians, not politicians

💥 2. Jailed MPs elected - Junqueras, Romeva, Rull, Turull and Sànchez - had political right to attend parliamentary sessions violated. In cases of Puigdemont, Sànchez and Turull a UNHRC decree requesting attendance at investiture for presidential candidates. All appeals rejected

💥 3. Violation of the right to an impartial judge
Lawyer @Boye, acting for Comín and Serret, rejects judge #Llarena as partial for his Palafrugell supper with #PP Barcelona leader Alberto Fernández Díaz and use of PP anti-independence terminology and argumentation in his rulings

💥 4. Violation of the right to defence
#LIarena stopped exiles' lawyers being present at hearings due to the absence of the accused. He rejected their testifying via video link although European law on judicial cooperation accepts this. Llarena didn't even reply to the requests.

💥 5. Violation of the right to the presumption of innocence
#Llarena has repeatedly rejected all appeals for conditional release for the political prisoners, often citing the risk of reoffending. As all are awaiting trial they're presumed innocent. His rulings presuppose guilt.

💥 6. Jurists warn that trying the MPs for rebellion is unconstitutional if their president, Carles Puigdemont, cannot be tried for this offence after the Schleswig-Holstein court's decision. This makes the trials of MPs nominated by him for the same offence completely incoherent

💥 7. #Llarena has committed offence by renouncing Puigdemont's extradition.
Elpidio José Silva: 'If I issue an EAW, I'm committed. They might find in my favour or not, but I can't withdraw. And if I don't prosecute for misuse of public funds I'm breaking Art.408 of penal code.
