Democrats will no doubt focus on Republican efforts to weaken protections:
ACA repeal and replace.
Expansion of short-term plans that don't cover pre-existing conditions.
The Trump administration's legal argument that ACA pre-existing condition protections should be invalidated.
The ACA's pre-existing condition protections include:
No denial of insurance.
No premium surcharges based on health or gender.
No lifetime and annual limits.
No pre-existing condition exclusions.
Guaranteed coverage of 10 essential benefits.
By taking over the House majority, Democrats have stopped ACA repeal and replace. But, since the ACA's pre-existing condition protections are still in place, Democrats face a challenge in coming up with legislation to keep the issue in the public eye.
