It’s a packed courtroom at Milimani Law Courts as we wait for the #NIIMSCaseDecision We’re hopeful 🤞🏾for a decision that affirms constitutional protections and fundamental rights to #privacy and due process
What’s at stake in the #NIIMSCaseDecision? The right to privacy (including freedom from undue surveillance), due process and public participation in law making, and the rights of marginalized and #stateless communities that have historically not benefited from citizenship
Court is now in session #NIIMSCaseDecision
Presiding judge has stated that the bench will make rulings on the case but the final decision with the reasoning will be issued on Friday (5 April, 2019) #NIIMSCaseDecision
Justice Korir is now making a summary of the ruling for applications for amicus curiae. Various organizations has applied to join the case as friends of the court. #NIIMSCaseDecision
Presiding judge now making a ruling on the application for conservatory orders. Conservatory orders are issued to stop or pause the implementation of a law or implementation of a law that are in the process of being contested in court. #NIIMSCaseDecision
BREAKING: The High Court has suspended the collection of DNA and GPS coordinates pending the determination of the #NIIMSCase #NIIMSCaseDecision
BREAKING: The High Court has also suspended the mandatory roll out of NIIMS. This means that the government cannot force any person to register in NIIMS. #NIIMSCase
The High Court has also barred the government from issuing deadlines for the collection of NIIMS data, from making registration to NIIMS a condition for receiving government services, or sharing NIIMS data with any foreign organization #NIIMSCase
These orders are in place pending the determination of the #NIIMSCase We still have an important legal battle against the government in favor of privacy, dignity and due process for the Kenyan people #SayNoToNIIMS #HudumaNamba
The court is now adjourned #NIIMSCase
A lot of you are asking, what’s next for the #NIIMS roll out? The roll out of the system was NOT suspended. Only the collection of DNA and GPS coordinates was suspended. HOWEVER, the government deadline was suspended and citizens can #BoycottNIIMS without government retaliation.
We consider the court ruling issued just now to deal a fatal blow to the attempted mass data surveillance of the Kenyan people. We are confident that this unconstitutional project will be declared null and void. #SayNoToNIIMS
