MSNBC reporting that the WH has instructed Don McGahn to defy the Congressional subpoena and NOT hand over the documents that were due per that sub by 10am today. They're trying to re-invoke EP, which they cannot legally do. #TuesdayThoughts

3-It's now being reported that McGahn's people have said that he will NOT hand the subpoenaed docs over to Congress until the White House and Congress have reached an agreement @ how to handle this. Nadler needs to take this directly to court.

4-@BarbMcQuade is saying that when the WH knew there was no way Trump could be charged w a crime re Mueller they let McGahn testify, now that he could be impeached they're asserting EP, the stakes are higher. And that the WH could effectively successfully withhold the docs..

5-Soo, can't Judiciary get these docs from Mueller's evidence? If the WH has grounds to withhold, wouldn't Mueller have had this paperwork? If so, it'd leave McGahn completely out of this document loop.
