cole white, the first of the four RAM defendants to plead guilty to federal conspiracy to riot charges for their involvement in the events of august 11 & 12, is being released into the custody of his father in california to await sentencing in october.
cole white entered a guilty plea in november 2018, months before his 3 co-conspirators. like the others, he was found guilty on only count one of the indictment.
assistant US attorney chris kavanaugh said holding him until sentencing in october would likely result in “overserving,” which must mean they anticipate him being sentenced to a year or less (he’s been in custody since october 2, 2018).
the three other RAM defendants (thomas gillen, benjamin daley, and michael miselis) all entered guilty pleas a few weeks ago. they are being held in central virginia regional jail awaiting their sentencing on july 19.
cooperation pays off. white appears to be facing under a year of incarceration. daley’s guilty plea included an agreement that 27-42 months was an appropriate guideline range. the maximum sentence for the charge is 5yrs. the judge will make the final determination at sentencing.
