Twitter has had a good run. Lots of people around the world have enjoyed the ability to call out corruption & abuse while tagging the abusers; previously unheard voices developed huge followings (for better or worse). But the new owner's lack of seriousness & forethought, and an almost exclusive focus on the US context, makes me doubt that it will survive to do all that, at least globally. It may not die, but ppl will find others ways to engage.

strong words from @POTUS at #UNGA today on human rights. much to admire, & yet...how much does the United States really use the Universal Declaration on Human Rights to "measure ourselves"? whitehouse.gov/briefing-room/… this is as much about us as it is about the rest of the world & I'm glad @POTUS concluded the way he did

this UK ruling, enabling a #Pegasus case to move forward against #SaudiArabia, is a *very big deal* as a matter of law, a blow against states seeking judicial protection against victims of their transnational repression. a preliminary-thoughts 🧵 theguardian.com/world/2022/aug… the legal question was, in part, whether the UK courts should follow U.S. court holdings that, for an exception to sovereign immunity to be applicable (i.e., to allow a suit against a state), the 'whole tort' had to take place in the UK.

how should the international community constrain the private #spyware industry? @MarietjeSchaake & i offer some ideas, a framework for global regulation. washingtonpost.com/opinions/2021/… few people have been tracking the global spyware problem as long as @MarietjeSchaake. see this from 2011! huffpost.com/entry/stop-dig…

story after story today expose the abuse of spyware technology developed & sold by #NSOGroup, authorized for transfer by #Israel. read, e.g., @skirchy here: theguardian.com/world/2021/jul… and @danapriest @craigtimberg @smekhennet here washingtonpost.com/investigations…

😲 #Israel not only "authorized" but "encouraged" NSO Group & others to sell spyware to #SaudiArabia *even after MBS' murder of #JamalKhasshogi, acc to @ronenbergman & @MarkMazzettiNYT. nytimes.com/2021/07/17/wor… the reporting underscores the opacity of these firms & Israel's licensing procedures. remember, whatever NSO and others say they are doing, it is not subject to any independent oversight. none. zilch.

well, he's asking the right question. that said... Image i would treat trump's tweets right now not as disinformation designed to influence the media's count-the-votes reporting - too late for that - but to incite his supporters (to violence? to the streets? to find ways to end vote counting?) and, as always, to salve his wounded ego.

The @nytimes editorial board has called for social media platforms to come together with clear standards to address election disinformation. Good for them! nytimes.com/2020/09/27/opi… as the Times put it... Image

in a better world, there would be no debate until trump commits to leave office upon his loss after all votes are counted. i mean, what’s the punishment for this threat to all of us? Image

god bless the memory of the great and brilliant Justice Ruth Bader Ginsburg did you need another reason to understand why november matters? why dems have to dominate? why there is absolutely no way the gop gets to push through a nom now?

this intense @RMac18 @CraigSilverman @PranavDixit piece highlights at least three points. the first is well known, namely: bad actors worldwide exploit *what the platform offers them* to manipulate the public the second is a recurring problem of failure to address major manipulation in what some might consider the 'periphery'. given that the platform's user base is mainly outside the US, this is unconscionable.

the legal risks of arms sales are the least of it, when you consider the humanitarian disaster the US has facilitated in #Yemen. Still, this is shocking, a major story, & i concur w/the quotes attributed to @oonahathaway & @rgoodlaw. a further note or two. with the advance of criminal/civil liability globally for war crimes, it's become essential for State Dept lawyers to lay out legal risks for policymakers. we did this in 2002, as i described in this thread.

I also have a 9/12 memory. 19 years ago today... i worked in “L”, the legal office @StateDept, handling int’l humanitarian law (mainly law of war/armed conflict). I came in early that morning and, tho my memory is hazy on the particulars, found a post-it note on my desk.

a simple, superficial and ultimately brief thread on this last day of my mandate as @UN special rapporteur on freedom of opinion & expression. pls read this first, the touchstone for the mandate #Article19 #ICCPR treaties.un.org/doc/publicatio… every major human rights institution has recognized that freedom of expression is essential to democratic society & to the enjoyment & promotion of every other right. as the Human Rights Committee has put it in General Comment 34: www2.ohchr.org/english/bodies…

such a nice dose of congratulations on my timeline, & i am really grateful, but - & this is genuine - i've enjoyed a privileged platform, & any work i've done as SR only had value because of the input of people much braver & more expert than me. all the way back to my first UN report in 2015, on #encryption & #anonymity, check out the list of orgs submitting ideas & expertise. freedex.org/encryption-and… that has always been the pattern.

the @ADL’s @JGreenblattADL clearly articulates the kinds of demands that human rights activists have been demanding from platforms for years (transparency, independent oversight, metrics). but one note of caution abt the goal as @donie reports right here... Facebook, YouTube/Google, Twitter & other supersized platforms will never *eliminate* all hate speech, even if you had some magical AI upload filter. not only does platform scale defeat that goal...

i agree with much if not all of this bloodless letter, signed by many ppl i really admire, but it’s like a giant subtweet. without identifying supposed anti-free speech culprits, it doesn’t really engage with the real hard questions of the moment. harpers.org/a-letter-on-ju… i bet the signatories have pretty different views on what to do with racist speech online or in the classroom. Or let’s say there’s a prof with Nazi sympathies. Where’s the marketplace of ideas in that?

i agree with this @AnandWrites thread but i would expand upon it in one way. free speech isn’t simply about a one-directional ‘right to speak’. the right to speak is hollow without the right to seek & receive information & ideas, to have access to sources of info, to develop opinions & then impart them. from #ICCPR ohchr.org/en/professiona… Image

this guy, @ianbremmer, is literally retweeting #China’s party newspaper as if it’s accurate. get a grip, man, & maybe read before you tweet. sure, it fits your convention wisdom take, but so what if Cuba read a statement? why not take a look at what Human Rights Council-appointed experts did *just last week*, a really major statement about the need for human rights compliance by #China? https://t.co/OTIbIZGXIf
