The State asserted that Adam never invoked his right to remain silent, but admitted that if he did at some point it is the context of that invocation that was ambiguous and should not be considered
The defense asserted that it was not ambiguous and that from the time Adam Montgomery said to any officer "I'm not talking to you" or "I have nothing to say" that Adam Montgomery was in fact invoking his right to remain silent.

A bail hearing for Kayla Montgomery, the stepmother of #HarmonyMontgomery, has been delayed until Jan. 24. Kayla is currently being held on $5,000 bail for welfare fraud charges. Her attorney filed a motion to have the bail revised. The AG objected and added new charges.
Kayla Montgomery is now facing eight more misdemeanor charges of welfare fraud connected to fraudulently receiving food stamp benefits for a child.
Prosecutors have dropped the Class A felony charge of welfare fraud but charged Montgomery with a new felony charge of theft under a different statute.
