In 2022, @CommonCauseNC won in Harper v. Hall to protect voters from partisan gerrymandering. The unconstitutional maps made by extremist lawmakers were redrawn.

Upset they didn’t get their gerrymandered maps, the lawmakers appealed to SCOTUS in #MooreVHarper.
Meanwhile a newly configured NC Supreme Court re-decided the Harper v. Hall, reversing the prior court’s decision today in a nearly unprecedented move.

The independent state legislature theory (ISL Theory) is on deck. And it's bad.

THE ISL theory posits that state courts are without power to review state legislative action when it comes to federal elections because the Elections Clause says the legislature *exclusively* has the power to set the time, place, and manner of federal elections.

It's absurd.
It's contrary to the Constitution. It's contrary to originalism, which Thomas and Alito love to dry hump when it suits them.

And it's contrary to common friggin sense.

But common sense and the rule of law don't matter anymore so here we are.

I read the Pro Publica piece on Moore and I just find it distressing that people who write about the law look around and see what is going on with this Court and still somehow believe in the Court as an institution that can fix the cracking open of democracy.
This writer cites a law prof who has written that Moore won't mean that state legislatures can overturn the will of the people in a federal election because Congress mandates that electors be selected before Election Day.
Does this person really think the GOP won't change that if given the chance?

I'm reading this guy's law review article and it's all about precedent and how the Court said this and Congress has mandated that.

But the point is, authoritarianism doesn't adhere to these rules!

CASE ALERT: This Wed., Dec. 7, the Supreme Court will hear argument in a case called #MoorevHarper. The case is based on how North Carolina congressional districts were drawn but it's also of national import. In fact, it might be the singular case to fully unravel our democracy.
Moore v. Harper involves a complicated sounding theory called ISLT or the “independent state legislature theory”, which is another way of saying that state legislatures—and not state courts--should be the final decider of whether a state’s election laws are constitutional.
This theory—that state legislatures are independent and final decisionmakers--would upend the U.S. Constitution’s carefully constructed system of checks on governmental and majoritarian abuses of power.
