@NinaTotenberg This is wrong: "if she [Barrett] had prevailed, [it] would have made it illegal in Indiana to get an abortion because of fetal disability." Indiana did not even request en banc review of the anti-eugenics law, and Easterbrook (joined by Barrett et al) did not seek it either.
@NinaTotenberg Judge Manion, on the panel, made dissatisfaction with Supreme Court doctrine clear, yet concluded that precedent condemned anti-eugenics law. We can't know whether Easterbrook, Barrett, et al would have reached the same conclusion, if case fully argued and briefed.
