Today in Kenosha, a jury found #KyleRittenhouse not guilty on all counts.

They reached the legally, and I believe morally, correct verdict.

The system worked...this time. But let's take the opportunity to talk about how it sometimes doesn't, and came close to failing here.🧵
Rittenhouse was fortunate enough to have the things a defendant is supposed to have, competent counsel and a sympathetic judge. Not perfect counsel, mind you, as a defense attorney myself I could backseat-lawyer them all day, but they did an overall good job.
A lot of people had concerns about the impartiality of Judge Schroeder, who repeatedly intervened on the defendant's behalf and seemed to hold the prosecution to higher standards than the defense. But this is actually how the system is SUPPOSED to work. It just...doesn't always

“America’s prisons, jails and detention centers have been among the nation’s most dangerous places when it comes to infections from the coronavirus.
Over the past year, more than 1,400 new inmate infections and seven deaths, on average, have been reported inside those facilities each day.
The cramped, often unsanitary settings of correctional institutions have been ideal for incubating and transmitting disease.
Social distancing is not an option. Testing was not a priority inside prisons early in the pandemic. With little public pressure, political leaders have been slow to confront the spread.”

I’ll post this every year until the time free is more than the time taken away.

9 years ago today, VA Dept of Corrections released a man who had given well over half his life to the system. He went in as a child and grew into a man.
Denied parole 17 times for nature of the crime. He was set up for failure but persevered. He was a hard-headed, fearless child who looked up to grown men who were in the streets. There aren't any excuses for doing wrong; he wears his wrongs and lives with them every day.
The most important thing in life is that he's learned from his mistakes... he took longer than most to get it, but he's turned his life around. He says to me all the time that just having the right people around you makes all the difference.

Alabama is another step closer to spending at least 2.6 billion on building three new prisons for men. I have never seen people so happy to spend this much money on a plan that doesn’t solve the problem, creates generational debt, and doesn’t buy us anything at all. #alpolitics
Let’s get a few things out of the way. You are going to hear that we are signing a 30 year lease. We aren’t. We can’t. It’s illegal. So instead, this “arrangement” is going to be a series of 30 1 year leases that will have to be renegotiated every year. #alpolitics
At the end of the 30 1 year leases (assuming we make it that far) we won’t own anything. We will neither own the prison nor the land they sit on. 2.6 billion and we won’t have anything to show for it. #alpolitics

Today, I'm celebrating new laws going into effect in #Virginia. So many people worked hard for YEARS - organizing, educating, advocating, messaging and winning elections for these changes. There are too many to list but here are a *few* of my favorite things (a thread):
âś… Expanded access to voting - no excuse absentee so anyone can vote by mail if they want to, 45-day in-person voting, repealing strict photo ID, AVR and same-day voter registration, making Election Day a state holiday and many more... #VotingRights
âś… Made Virginia a better place for immigrants - allowing everyone to lawfully drive regardless of status, in-state tuition, Office of New Americans, prohibiting law enforcement from asking immigration status of witnesses and victims of crime... #heretostay

1/10 Today I introduced the Wisconsin Corrections Reform and Reinvestment Initiative. The reforms address non-criminal revocations; Wisconsin’s earned release system; and changes to community supervision.
2/10 #CriminalJusticeReform has become a national, #bipartisan issue with ~45 states who have already made steps for reforming the system.
3/10 In WI, we face the reality of either building a new prison to house the growing population or reform the system. I make the case for reform.

Friday Thread on #CriminalJusticeReform in Oregon:

Yesterday ended a 20 month journey repping a young client (under 25) who started out as a giant pain in the ass & then turned into 1 of my favorite clients ever.
It started with Client who wound up facing 6 cases w/ a possible 15 convictions on the line, ranging from contempt to misdemeanors to C level felonies.

The PDs office had a conflict & so I was appointed to the case.
If PDs office had case, more than likely would've been pressure to resolve all cases with a “global” – a person pleads to some charges in exchange for state dismissing the rest. The ratio depends on many factors largest being the county charges are in & the specific prosecutor.
